Program Overview

Oswald will review a claim case study and provide a roundtable discussion. The purpose is to be able to identify red flags associated with claims during the design and construction phases of a project. The roundtable will provide additional opportunities for participants to discuss contrasting points of view.

Technical and non-technical issues during the design and construction phases are critical for the success of a construction project. It is extremely important to understand the drivers of claims.  Failure to be able to identify potential risks can be catastrophic for the project and the safety of the building and the design professional.

Learning Objectives

  • Participants will review a case study of a claim involving the structural systems of a building which was filed against a design professional. Attendees will be able to identify and determine the need for alternative materials or methods (for example) to mitigate the impact of  a risk to the execution of the project design or risks the design poses to the soundness or health impacts of a building, a site or its occupants and users.

  • Participants will understand various drivers of risk in potential claims against design professionals. It is important to understand how technical and non-technical issues during the design and construction phases can affect the safety and the welfare of occupants of a building.  

  • Attendees of this program will learn about contractual responsibilities in relation to delegated design items. They will learn how communications between the Owner, Contractor, and Architect teams, initiated early in construction, can avoid costly claims, retrofits, and safety issues of the structural systems. 

  • Attendees of this presentation will learn the steps they can follow to identify opportunities and improve risk management practices during the design process, while maintaining the primary goal of the health, safety and welfare of the buildings. 

  • After completing this program attendees will be able to examine the project or practice management processes they have in place (or may need to specify) to appropriately evaluate proposed systems, materials, or methods intended to safeguard the users of buildings or sites.
